As used in this Policy, you are accessing, using, or receiving our services (“Services”) when you:
Access or use the Equation 2 Success online course, Skoolturf (“Course”), the Equation 2 Success Website (“Website”), any of the services provided or otherwise made available through the Course and/or Website (together, “Services”), or any of our other websites or Services that incorporate this Policy, either directly or through a third-party application or service, as well as any services made available in our Skoolturf Terms of Use (“Terms”), incorporated herein by reference; or
Communicate with us, including submitting an inquiry through our Website, or Services provided in connection with the Course, corresponding with us by phone, email, or otherwise, subscribing to one of our mailing lists, or providing information requested by us to comply with our professional obligations.
For avoidance of confusion, “you” or “your” in this Policy refers to all users, which includes students (of all ages), parents, teachers, administrators, and authorized external partners, of our Services (“Users”), as further defined in section 3 of our Terms.
Geographic Restrictions
Equation 2 Success, the owner of the Services, is based in the State of California in the United States. We provide these Services only for persons located in the United States. If you access the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws. To the extent permissible by law, your use of the Services where their content is illegal or in ways that are illegal in any geographic region, whether within or outside of the United States, is strictly prohibited. This Privacy Policy is governed by, and construed in accordance with, the laws of California, without regard to its conflict of laws principles. By using our Services, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Los Angeles, California, for any dispute arising out of or relating to this Privacy Policy.
What Personal Information Do We Collect?
As used in this Policy, personal information means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, either directly or indirectly, with a particular individual or household (“Personal Information”). For avoidance of doubt, Personal Information may include demographic data such as teacher data (location, years of experience, areas of expertise, etc.), age, race, ethnicity, region, income level, and familiarity with technology, which may be collected via assignments and questions in modules found within the Course that ask questions regarding issues that fall within the scope of the Scope or other Services.
We collect Personal Information about you when you voluntarily submit information directly to us by accessing, using, or receiving the Services. We may also collect Personal Information from third parties, such as schools, third-party service providers, authorized external partners, or through the use of cookies and other similar technologies. For avoidance of doubt, “school” or “schools” in this Policy refer to a formal educational institution in charge of educating individuals that are 18 years old or younger and may, by extension, include one or more school district, teacher, or authorized school user and administrator (collectively, “School”) within an educational setting. Additionally, we may automatically collect information about you or the device through which you access our Services.

Information we collect directly from you or from your School
Personal Information we collect from you or from your School (if applicable) may include, but is not expressly limited to, the following information:
Full Name
School, age of the students you teach, subjects you teach, and classroom affiliations
Contact information, including email address and mailing address
Phone number
User-generated content
Account information
Access and usage data about your use of the features and functionality of the Services
Information we collect from third parties.
Single Sign On: You may choose to access, use, or receive the Services by logging on or otherwise associating with another third party (for example, through a Thinkific account). In those cases, we may receive Personal Information from that third party to help you create an account on the Services and to display a relevant contact for you, such as your name, username, or email address. The amount of personal information we collect from such third parties may depend on the privacy settings you or your School(s) have with that third party. Please consult the third party’s privacy policy and data practices for more information.
Other Sources: We may get your information from other sources, including through our service providers, business partners, or through transactions such as mergers and acquisitions. We use this information in order to operate, maintain, and provide the functionalities and features of our Services to you. We may combine information with the other information we collect from you or from your School. In those cases, our Policy governs the handling of the combined Personal Information.

We and our third-party service providers may automatically collect information about you and your mobile device or computer when you access, use, or receive our Services by using certain technologies listed below. These technologies help us to learn more about how our users like to engage with our Services and to improve the functionality of our Services. These technologies may include:

We use the Personal Information we collect to:

Who Do We Share Your Personal Information With?
In accordance with how we use your Personal Information, we may share your Personal Information with the following:
Other Users of the Services. We may share your personal information with other registered users of our Services, such as other teachers and administrators. Other Users may be able to see your profile information (e.g., username), view the information and other content you post through the Services, and communicate with you within the Services. Some of your data that is visible to others may depend on your privacy settings. For more information, please refer to “How Can You Manage Your Information Preferences and Controls.”
Schools, District Administrators, and Teachers. We may share your Personal Information with Schools, including their teachers and administrators, so they can engage with our Services, understand student performance, and tailor content and materials for educational use.
Educational Partners. We may share your Personal Information with our authorized educational partners who help us to improve our Services and work with Schools, including teachers and administrators, to further academic enrichment.
Third-Party Service Providers. We may share your Personal Information with third party vendors, independent contractors, and other service providers that perform services for us and support our business, on our behalf, which may include web hosting, file sharing, single-sign on capabilities, providing analytic services, providing mailing or email services, tax and accounting services, payment processing, data enhancement services, fraud prevention, or obtaining legal counsel and/or representation. In particular note, the applicable third-Party Service Providers may include but are not limited to HubSpot, our customer relationship management and marketing automation platform, which we use to manage User interactions, analyze User online behavior, and send communications to User. In doing so, we may provide HubSpot with your Personal Information such as your email address, website activity, and interaction history for the purposes of email outreach, analytics, and customer support. HubSpot’s use of information is governed by their privacy policy and is distinct from Equation 2 Success’s use of your Personal Information. Equation 2 Success is not responsible for HubSpot’s handling, use, or stewardship of any Personal Data shared with HubSpot as a Third-Party Service Provider, and such data is subject to HubSpot’s own privacy practices and terms.
Law Enforcement, Regulators, and Other Parties for Legal Reasons. We may share your Personal Information with third parties as required by law or if we believe such action is reasonably necessary to comply with any court order, law, or legal process, including to respond to any government or regulatory request. We may also share your Personal Information to enforce our rights arising from any contracts entered into between you and us, including our Terms skoolturf.thinkific.com/pages/terms, or if we believe disclosure is necessary to protect the rights, property, or safety of Equation 2 Success, you, other Users, or others.
How Do We Respond to Do Not Track Requests?
Some browsers have incorporated “Do Not Track (DNT)” features that can send a signal to the websites you visit indicating you do not wish to be tracked. California law requires us to let you know how we respond to these DNT signals.
Equation 2 Success does not currently respond to browser DNT signals. However, we do not track our users over time or across other websites to provide targeted advertising. For the avoidance of doubt, Equation 2 Success does not own or control Thinkific, the platform used to house and facilitate access to our Services, namely the Website.
Do We Market and Advertise to Users?
Aside from marketing other Equation 2 Success owned websites to Website visitors, we do not display advertisements on our Services to our Users.
How Can You Manage Your Information Preferences and Controls?
You may, at any time, log into your Thinkific account and manage or modify the Personal Information stored in your account. In addition, you may contact us at [email protected] for any questions or concerns about the Personal Information we have about you.
How Do We Secure Your Personal Information?
We take the appropriate handling of your Personal Information very seriously. That is why we have implemented policies and workplace practices designed to prevent your Personal Information from being lost, used, accessed, altered, or disclosed in an unauthorized or unlawful way.
Unfortunately, although we do our best to protect your Personal Information, we cannot and do not guarantee that Personal Information is completely secure and safe from such risks. By using the Services, you understand and assume the risks associated with your activities on the Internet, our Course, and our Website.
